In Texas, you no longer can have an open container of alcohol in your car. Not long ago, you could have an open container, but the driver of the car could not drink alcohol while driving.

A person commits an offense if the person knowingly possesses an open container in a passenger area of a motor vehicle that is located on a public highway, regardless of whether the vehicle is being operated.

An open container means a bottle, can, or other receptacle that contains and amount of alcoholic beverage and that is open, that has been opened, that has a broken seal, or the contents of which are partially removed.
A passenger area of a motor vehicle means the area of a motor vehicle designed for seating of the operator and passengers. The trunk is not a passenger area. So, if you are transporting a previously opened bottle, put it in the trunk.

This is a Class C offense. An open container with a DWI arrest can lead to additional jail time.
