A person commits an offense if the person appears in a public place while intoxicated to the degree that the person may endanger the person or another.
This offense is a Class C misdemeanor
A person generally get arrested for this offense when a police officer thinks they are too drunk to be walking around. Or, perhaps they are the passenger in a car, and the driver gets arrested for DWI. If the officer thinks the passenger is too intoxicated to drive or walk home, they may arrest the person for Public Intoxication.
All that the police officer has to say is the person was an unreasonable danger to self or someone else. They may state the person was going to stumble into the road, or just about anything else. The police do not have to give field sobriety test, or offer a breath test. They should, but most of the time they don’t. This truly is a case of their opinion over the defendant’s.
There are additional penalties for people under 21.
